特別養護老人ホームでの業務上過失致死被告事件
―間食後に死亡したケースで問われた職員の刑事責任―

長野県の特別養護老人ホームにおいて利用者に間食を提供するに当たり、ドーナツを配膳した職員に過失が存在したか。その結果、心肺停止に起因する低酸素脳症等により、同人を死亡させた罪が問われた事件である。刑事責任について、原審は過失を認定し被告人を有罪としたが、被告人が控訴を申し立てていた。東京高等裁判所は原判決を破棄して、被告人を無罪とした。

Abstract
At a special nursing home in Nagano Prefecture, a facility worker served a donut as a snack to a resident, who later died mainly due to hypoxic ischemic encephalopathy after cardiopulmonary arrest. The focus of this case is on whether or not this worker is guilty of negligence resulting in the resident’s death. The defendant was found criminally liable and guilty of negligence in the original decision, and she filed an appeal. The Tokyo High Court overturned the original verdict and found her not guilty.
